1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders, purchases, deliveries, and services in connection with Dr.Scent Switzerland, both via the online shop and in retail sales at the Rümlang location.

The contractual partner and operator is exclusively Swiss Creative Company GmbH.

By purchasing in-store or submitting an order in the online shop, the customer agrees to these GTC.

3. Conclusion of Contract

3.1 Online Shop

The presentation of products in the online shop does not constitute a legally binding offer but an unbinding invitation to order.

By completing the order process, the customer submits a binding offer to purchase the selected products.

The contract is only concluded by:

  • express acceptance,
  • shipping confirmation, or
  • shipment or handover of the goods.

Automatically generated order confirmations serve only as information about the receipt of the order.

3.2 On-site Purchase

For purchases made in the retail store, the contract is concluded upon successful payment and handover of the goods.

4. Products and Representation

Dr.Scent Switzerland sells high-quality fragrance products, accessories, and technical fragrance solutions.

All information regarding products, designs, colors, packaging, technical data, or illustrations is provided with the utmost care. Minor deviations are reserved, provided they are reasonable and do not impair quality or function.

5. Prices

All prices are in Swiss Francs (CHF).

Where legally applicable, prices include value-added tax.

The prices published at the time of purchase are decisive.

Price changes, obvious errors, technical errors, or typos are reserved.

6. Payment Methods

Depending on the sales channel and technical availability, the following payment options are available:

  • Shopify Payments
  • Apple Pay
  • Google Pay
  • TWINT
  • PayPal
  • Heylight (interest-free installment payments according to the provider's terms and conditions)

When selecting external payment providers, their own contractual and data protection provisions also apply.

We reserve the right to exclude individual payment methods in specific cases.

7. Delivery and Shipping

We deliver exclusively within Switzerland.

Delivery is generally made via Die Schweizerische Post AG or an equivalent shipping partner.

Stated delivery times are indicative, unless a binding date has been expressly guaranteed in writing.

Delivery delays due to force majeure, official orders, supply bottlenecks, traffic events or other circumstances beyond our control do not give rise to claims for damages.

8. Availability

Should an item be unavailable after the conclusion of the contract or cannot be delivered despite proper procurement, we reserve the right to:

  • withdraw from the contract in whole or in part, or
  • offer an equivalent replacement product.

Payments already made for unavailable products will, of course, be refunded.

9. Retention of Title

The delivered goods remain the property of Swiss Creative Company GmbH until full payment.

10. Inspection of Goods / Notification of Defects

Customers are obliged to inspect the goods received promptly upon receipt.

Obvious defects, incorrect deliveries, or transport damage must be reported to us in writing by e-mail within a reasonable period.

Mandatory statutory warranty rights remain reserved.

11. Warranty for technical products

Unless otherwise stated, we provide a warranty of 2 years from the date of purchase or delivery for technical fragrance devices.

Warranty services are provided at our discretion through:

  • Repair, or
  • Replacement of the product.

The warranty excludes damages resulting from:

  • Improper use
  • Faulty installation
  • Lack of maintenance
  • Normal wear and tear
  • External influences
  • Water, fire, or electrical damage
  • Unauthorized intervention
  • Use of unsuitable third-party products

Further mandatory statutory claims remain reserved.

12. Returns / Exchanges

Under Swiss law, there is no general statutory right of withdrawal for ordinary purchase agreements.

For this reason, there is no right to return, exchange or refund for faultless and properly delivered goods, neither for purchases in the online shop nor in the physical store.

Returns are made solely on a voluntary basis and with our prior express consent.

Claims for proven defects or incorrect deliveries remain unaffected.

13. Liability

We are liable for direct damages only in cases of intentional or grossly negligent breach of duty.

To the extent permitted by law, any liability for slight negligence, indirect damages, consequential damages, lost profits, data loss or business interruption is excluded.

Mandatory statutory liability provisions remain reserved.

14. Intellectual Property

All content, brands, logos, product names, texts, images, designs and other elements related to Dr.Scent Switzerland are legally protected.

Any use without prior written consent is prohibited.

15. Data Protection

The processing of personal data takes place in accordance with the current privacy policy.

This can be viewed on the website.

16. Applicable Law / Place of Jurisdiction

Substantive Swiss law applies exclusively.

To the extent permitted by law, the exclusive place of jurisdiction is the registered office of Swiss Creative Company GmbH.

Mandatory statutory places of jurisdiction remain reserved.

17. Final Provisions

Should individual provisions of these General Terms and Conditions be wholly or partially ineffective, the validity of the remaining provisions remains unaffected.

A legally permissible provision that comes as close as possible to the economic purpose shall replace the ineffective regulation.
